Your access to and use of this website, as well as all related websites operated by Loot Studios (Kraken Produtos Digitais Ltda.), which includes lootstudios.com (collectively the “Site”), is subject to the following terms and conditions (“Terms and Conditions of Use”) and all applicable laws and regulations. By accessing and browsing the Site, you agree to be bound, without limitation or qualification, by these Terms and Conditions of Use and acknowledge that any other agreements entered into between you and the Site are superseded and of no force or effect.
You agree that the Site itself, as well as all content, videos, training materials, products, services and/or any other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing (collectively referred to as the “Content”), are maintained for your personal use and information by Loot Studios (the “Company”), are subject to intellectual property laws and are either owned or used with permission by the Company.
You agree that such Company Content shall include all proprietary videos, HTML/CSS, JavaScript, graphics, voice and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms and Conditions of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes, excluding any and all commercial purposes.
No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose other than personal use is a violation of the copyright and other proprietary rights of the Company, as well as other authors who created the materials.
You may not distribute, modify, transmit, sell, or use the content of the Site or any Content, including any and all software, tools, graphics, and/or sound files, for public or commercial purposes without the express written permission of the Company.
YOU AGREE THAT THE COMPANY MAY USE METHODS OF IDENTIFYING THE CONTENT MADE AVAILABLE TO EACH USER OF THE LICENSE IN A PERSONALIZED MANNER, ESPECIALLY TO VERIFY ANY VIOLATIONS OF THESE TERMS AND CONDITIONS OF USE, AND THAT IN CASE OF BREACH BY ANY USER, THE COMPANY SHALL BE ENTITLED TO SEEK INDEMNIFICATION AND TO PURSUE THE APPLICABLE CIVIL AND CRIMINAL ACTIONS, AS WELL AS TO CANCEL OR SUSPEND ANY LICENSE RELATING TO SUCH A USER.
All Content, such as text, data, graphics files, videos, and sound files, and other materials contained in the Site, are copyrighted unless otherwise noted and are the property of the Company and/or a supplier to the Company.
1.1 Subscription Start and Billing
By starting your Loot Studios subscription and providing or designating a payment method, you become a Member and authorize us to charge you a recurring subscription fee at the then-current rate. We reserve the right to adjust pricing for our subscriptions in any manner and at any time, at our sole and absolute discretion. Except as otherwise expressly provided in these Terms, any price changes to your subscription will take effect following notice by email.
1.2 Updating Payment Information
You must provide and keep up-to-date accurate contact and payment information, including name, billing address, and credit or debit card number. We store your payment information for ease of future charges. All personal information is subject to the Privacy Policy.
1.3 Recurring Payments and Cancellations
BY PURCHASING ANY SUBSCRIPTION, YOU ACKNOWLEDGE THAT YOUR SUBSCRIPTION HAS AN INITIAL AND RECURRING PAYMENT FEATURE AND ACCEPT RESPONSIBILITY FOR ALL RECURRING CHARGES PRIOR TO CANCELLATION. YOUR SUBSCRIPTION WILL BE AUTOMATICALLY EXTENDED FOR SUCCESSIVE PERIODS. TO CANCEL YOUR SUBSCRIPTION, YOU MAY USE THE CANCELLATION FUNCTION AVAILABLE THROUGH YOUR ACCOUNT, WHEN PROVIDED, OR CONTACT SUPPORT AT support@lootstudios.com. CANCELLATION REQUESTS MUST BE SUBMITTED BEFORE THE NEXT RENEWAL PAYMENT IS PROCESSED TO PREVENT FUTURE BILLING. IF A RENEWAL PAYMENT HAS ALREADY BEEN PROCESSED, THE CANCELLATION WILL TAKE EFFECT AT THE END OF THE CURRENT BILLING PERIOD AND NO REFUND WILL BE ISSUED, EXCEPT AS REQUIRED BY APPLICABLE LAW. CANCELLATION OF A SUBSCRIPTION DOES NOT ENTITLE THE USER TO A REFUND OF AMOUNTS ALREADY PAID, EXCEPT WHERE REQUIRED BY APPLICABLE LAW.
By using the Services, you consent to receive notices, disclosures, updates, and communications electronically, including by email or through your account dashboard.
1.4 Loot Rewards System
When you subscribe, you enroll in our Loot Rewards system. Loot Coins act as virtual currency earned through subscription duration and purchases made via the My Cart feature. You can exchange Loot Coins for rewards, including legacy bundles, special characters, game accessories, and environment packs.
1.5 Membership Tiers
We offer different subscription plans with distinct benefits, which are detailed on our website.
1.6 Upgrade and Downgrade Policy
Upgrading your plan allows access to additional benefits according to the selected tier. If you downgrade, you retain the benefits already redeemed under your previous plan. However, future benefits will follow the rules of the new, downgraded plan.
1.7 Refund Policy
You may request a refund within seven (7) days from the date of purchase or subscription renewal, as applicable. Refund requests are subject to review and may be denied if any benefits associated with the subscription, such as access to content or rewards, have been partially or fully utilized during the billing period.
For the avoidance of doubt, automatic redemption of bundles pursuant to Section 1.8 shall constitute use of subscription benefits for the purposes of this clause.
In the event of an approved refund, access to all related benefits will be revoked, and your account will be reverted to the default plan (Free Account).
Nothing in this Section prevents a user from contacting Loot Studios Support after the expiration of the seven (7)-day refund period. In exceptional circumstances, including technical issues, billing errors, duplicate charges, unauthorized transactions, or other situations reasonably determined by Loot Studios to warrant further review, the Company may evaluate refund requests on a case-by-case basis. Any such review shall be conducted at Loot Studios’ sole discretion and shall not create any obligation to provide a refund beyond the rights otherwise granted under these Terms or applicable law. Loot Studios reserves the right to deny any refund requests that do not comply with these conditions. Nothing in this Section shall limit, exclude, or waive any non-waivable rights granted to consumers under applicable law, including the Brazilian Consumer Protection Code where applicable.
1.8 Additional Terms for Single and Double Plans
If you subscribe to a Single or Double plan, additional terms regarding bundle selection apply.
Single Loot → 1 bundle per month
Double Loot → 2 bundles per month
You can freely choose between Fantasy and Sci-Fi (or mix both).
Monthly choices are granted on the 1st of each month and are valid for 30 days. The thirty (30)-day validity period corresponds to the bundle selection window described below.
If you don’t use your choices, they will be automatically redeemed for the latest bundles.
Bundle Selection Window:
You must select your bundle within thirty (30) days of your subscription’s initial payment.
For subsequent months, the same thirty (30)-day selection window will apply following each renewal date.
If no selection is made within this period, a bundle will be automatically assigned according to the rules below.
Single Loot:
It will be automatically redeemed for the most recent Fantasy bundle available.
Double Loot:
It will be automatically redeemed for the latest two Fantasy bundles available that you do not own.
This ensures you never lose value from your subscription.
We recommend selecting your bundles before the 30-day expiration.
Exhaustion of Available Bundles:
If you no longer have bundles available to redeem under the Single Plan, it will be redeemed for the Fantasy bundle launched each month.
If you have the Double Plan, it will be redeemed for both the Fantasy and Sci-Fi bundles launched each month.
All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademark “Loot Studios”, are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms and Conditions of Use. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/or third parties, and will subject the user to the penalties provided by applicable intellectual property and unfair competition laws, especially Brazilian Law No. 9,279 of 1996 (Industrial Property Law).
Nothing contained in this Agreement or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Company or third party owner.
The Company respects the copyright, trademark and all other intellectual property rights of others. The Company has the right, but not the obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify Company at support@lootstudios.com. Please provide your name and contact information, the nature of your work, and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.
2.1. USE OF CONTENT FOR ARTIFICIAL INTELLIGENCE
Unless expressly authorized in writing by Loot Studios, users may not use, reproduce, extract, copy, process, make available, or otherwise exploit any Content, Bundle, 3D model, STL file, artwork, image, text, metadata, or other materials provided by Loot Studios for the purpose of training, developing, validating, fine-tuning, operating, or improving artificial intelligence systems, machine learning models, generative AI systems, training datasets, or similar technologies.
Users are also prohibited from using Loot Studios Content to create datasets, training corpora, digital libraries, or competing products, whether for commercial or non-commercial purposes.
Any use in violation of this clause shall constitute an infringement of Loot Studios’ intellectual property rights and may result in all available legal remedies.
By using the Site, you accept our Privacy Policy, available at https://www.lootstudios.com/pages/privacy-policy. We collect, process, store, transfer, and protect personal data in accordance with the Lei Geral de Proteção de Dados Pessoais (LGPD — Lei nº 13.709/2018), the General Data Protection Regulation (GDPR) where applicable, and other applicable data protection laws.
We implement technical and organizational measures appropriate to ensure a level of security appropriate to the risk in accordance with Article 46 of the LGPD. In the event of any conflict between these Terms and the Privacy Policy with respect to the collection, processing, storage, transfer, or protection of personal data, the Privacy Policy shall prevail.
While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations of any kind as to its accuracy. The Company also makes no representation, warranty, guarantee or promise that the products, website, or services will meet your requirements or achieve any particular results. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
You agree that your use of the Site shall be at your sole risk and that you will be solely responsible for any damage to your hardware or loss of data that results from the download of any Content.
User Submissions
If you send comments, suggestions, ideas, feedback, concepts, drawings, images, designs, computer programs, or other materials to the Company regarding the Site, the Services, Content, products, features, or business operations, you grant Loot Studios a perpetual, worldwide, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, adapt, modify, publish, distribute, display, create derivative works from, and otherwise exploit such submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
You represent and warrant that you have all rights necessary to submit such materials and to grant the rights described above. No submission shall be subject to any obligation of confidentiality by the Company unless expressly agreed in writing.
The Company shall use commercially reasonable efforts to restrict unauthorized access to its data and files. However, no system, whether or not password protected, can be entirely impenetrable. You acknowledge that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.
You are responsible for maintaining the confidentiality of your user ID and password. You are also responsible for all uses of your user ID and password, including any related charges. If you are a personal representative of the user, you represent that you have the user’s permission to use the company platform on his behalf.
Loot Studios has taken measures it considers appropriate to ensure the security and confidentiality of any information you provide to this platform. This includes technical security measures to avoid unauthorized access. However, the Internet is not secure and is not under the Company’s control. Use of the Internet is entirely at your own risk and is subject to applicable laws and regulations.
The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms and Conditions of Use.
This agreement shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil.
Subject to any non-waivable rights granted to consumers under applicable law, the courts of the City of Belo Horizonte, State of Minas Gerais, Brazil, shall have exclusive jurisdiction to settle any disputes, controversies, or claims arising out of or relating to these Terms and Conditions of Use.
Language: These Terms may be made available in multiple languages. In the event of any inconsistency between language versions, the version applicable under the mandatory laws governing the user’s relationship with Loot Studios shall prevail. For users located in Brazil, the Portuguese version shall prevail to the extent required by Brazilian law. For users located outside Brazil, the English version shall prevail unless mandatory local law requires otherwise.
